Constitution of Titulia

We the founders of Titulia, in order to form a democratic community, do establish this Constitution for the Republic of Titulia.

The Republic of Titulia is a limited democracy. It is limited by its web based existence. Some fundamental political and economic structures and the election processes are mandated by the software of the website of the republic, therefore the citizens or their elected representatives can not change them at will. These are under the ultimate control of the Administrators of this website. The purpose of the Constitution is to summarize these fundamental rules.
 
The power on any other matter is vested in the People of Titulia, who can directly, or indirectly through their elected representatives, create any other laws and regulations as long as they do not contradict the Constitution.
 
The use of the Titulia website is subject to acceptance of the Terms & Conditions and the Constitution of the Republic.
 
Article I. - Rights of Citizens
 
1. Any natural person shall have the right to:
 
- Immigrate to the Republic of Titulia, and therefore become a citizen, by registering at the official website of the republic. Any natural person may have one, and only one citizenship. Multiple citizens who ever show up on the same computer may be considered the same person.
 
- Have their voices publicly heard in public forums of the republic, as well as on their personal web logs (blogs).
 
- Make propositions to the public on any matter and seek the opinions of the public on those matters.
 
- Found or join parties. Any citizen may be the member of one and only one party at a time.
 
- Run for presidency of the party branch they belong to.
 
- Elect the president of the party and the party branch they belong to.
 
- Elect the president of the republic.
 
Article II. - The Parties
 
 
1. Any citizen not currently a member of an existing party may initiate the foundation of a new party. The founding member of the party will serve as its first president.
 
2. A party will be officially founded when the number of its members reaches 10.
 
3. Parties consist of branches. Citizens will be members of branches, and not directly of the party. Therefore, all parties must have a minimum of 1 branch, which should be founded at the time of the foundation of the party.
 
4. Any member of the party shall have the right to initiate the foundation of a new branch within the party. The branch shall be officially founded when the number of its members reaches 10. The founding member of the new branch will serve as its first president.
 
5. Citizens may apply for their admission to a specific branch of a party. Members of other parties may not apply for party membership - if they wish to do so, they have to leave their current party first.
 
6. The method of admission of new members into a party shall be determined by the president of that party.
 
7. Members of a party may be expelled from the party, by a method determined by the president of the party.
 
8. Any member of a party branch may initiate the election of a new branch president. Any member of the branch may be nominated for the presidency.
 
9. Presidents of founded branches may initiate the election of a new party president. Presidents of founded branches may be nominated for the presidency of the party.
 
Article III. - The Presidency
 
1. The executive power shall be vested in a President of the Republic of Titulia.
 
2. The responsibility of the executive branch, lead by the President, is to execute the will of the People of Titulia.
 
3. Presidents of founded parties may initiate the election of a new president of the republic. Presidents of founded parties may nominate one citizen for the presidency of the republic.
 
4. The president shall address the citizens of Titulia in the English language.
 
5. The President shall be removed from office on impeachment for, and conviction of, treason, bribery, or other high crimes and misdemeanors.
 
Article IV. - Elections
 
1. Elections of the presidents of party branches, parties, and the republic may have two rounds.
 
2. If any candidate receives more than 50% of votes in the fist round, becomes president.
 
3. In case of no candidate receiving more than 50% of votes in the first round, a second round will be held with the two candidates receiving the highest number of votes.
 
4. In case of equal number of votes, the winner will be determined based on seniority.
 
Article V. - The Legislative Branch of Government
 
1. The legislative power shall be shared between the People of Titulia and the Administrator of Titulia.
 
2. The power to make any changes to the Titulia website shall be ultimately vested in the Administrator of Titulia.
 
3. The Administrator of Titulia shall have the right to:
 
(a) Amend the Constitution with reasonable notice to all citizens.
 
(b) Amend the Terms & Conditions with reasonable notice to all citizens.
 
4. The power on any other legislative matters shall be vested in the People of Titulia. The People of Titulia exercise their powers either directly, or indirectly through an elected Government (and a future Senate).
 
Article VI. - The Judicial Branch of Government
 
1. The judicial power shall ultimately be vested in the Administrator of Titulia.
 
2. The Administrator may delegate any or all judicial powers to a General Court, or any additional Courts, established by the People of Titulia through their elected Government.
 
3. The Administrator of Titulia shall have the right to:
 
(a) Enforce the Constitution and the Terms & Conditions.
 
(b) Strip away any and all rights of citizens who violate either the Constitution or the Terms & Conditions based on the judgment of the Administrator or on the recommendation of the General Court, so established in s.2.
 
AMENDMENT I. - Officials
 
The President of the Republic may establish official government positions and appoint citizens of his / her choice to those positions.
 
AMENDMENT II. - The official newspaper of Titulia
 
The Republic of Titulia shall operate an official newspaper. The mission of the paper is to inform, educate and entertain. It shall consist of articles witten by the citizens of Titulia, and shall be edited by an editorial board, appointed by the President of the Republic.
 
It shall be the repsonsibility of the President to appoint an editorial board that operates a quality newspaper in an impartial, independent and honest manner.
 
AMENDMENT III. - Propositions
 
Propositions on general political issues are accepted as official policy of the Republic as long as they receive majority support.
 
Propositions that, by their nature, result in required changes to the functionality of the website of the Republic, fall under the ultimate authority of the Administrator to accept or veto. The Administrator of the Republic shall, on a regular basis, publish a report to summarize the status of these propositions.
 
AMENDMENT IV. - The Bank of Titulia
 
The Republic of Titulia shall create a national bank, the Bank of Titulia, to enable the creation and development of the economy of Titulia by issuing the Titulian currency, and administering financial transactions in that currency. The bank shall operate independently from the government of the Republic.
 
AMENDMENT V. - Government Budget
 
The elected Government of Titulia shall have a national budget. Revenues of the government budget shall originate from contributions of the Titulian citizens & companies, as well as regular emissions by the Bank of Titulia. The President shall be responsible for the proper allocation of the government budget.
 
AMENDMENT VI. - Titulian Companies
 
Titulian citizens shall be entitled to create and operate profit or non-profit companies for any legal purpose. Titulian companies must accept Titulian currency for their products and services.
 
AMENDMENT VII. - Changes to the Constitution
 
1. The Constitution, and therefore the way the website of the republic works, can be changed by the Administrator only.
 
2. The Administrator changes the Constitution on their own initiative or based on a citizens' change request.
 
3. The Administrator will accept citizens' change requests from the President of the Republic only.
 
4. The procedures of how citizens' change requests are created and selected for sumbmission by the President is out of the scope of this constitution.
 
5. Upon receipt of the change request, the Administrator may
 
(a) Ask the president for further clarification
 
(b) Recommend minor changes to the change request for technical reasons
 
(c) Accept the change request
 
(d) Reject the change request.
 
6. If accepted, the Administrator shall analyze the work associated with the implementation of the change request and respond to the president with an estimated completion date.
 
7. If rejected, the Administrator shall respond to the President with a description of the reasons of rejection.
 
8. Change requests and official responses to them will be public.
